Home Business Structure!

Deciding On Your Business Structure
More and more people are starting home based businesses. Many hobbies have turned into money making ventures that eventually required. The fact is all businesses have to be aware of, conform, or meet a range of legal obligations or requirements. One of the first considerations will be the type of business structure best suits your needs. The legal form under which your business will operate will vary depending on the location (ie U.S, Australia etc. Although the terminology and legal requirements will vary from country to country the basic forms of a business structure are:

Sole Trader
This is the simpliest business structure and is the most common for new home business owners. This is where the business is owned and operated by one person who is responsible for the running, decision making and receives all the profits. A sole trader can trade under their own name or a registered business name.

Company (Incorporated)
Establishing a company is the most practical way to start a business. The company itself is
a seperate legal entity with responsibiliy for all decision making resting with the entity itself. The business owner(or owners) would become directors of the company in order to gain control of decision making activities. Many sole traders establish companies as they grow to allow for perpetual succession and potential tax benefits (depending on the country).

Partnership
A partnership can include 2 or more people. This may suit you if you are planning to go into business with someone else. Partners will generally own the business equally and therefore share profits, share costs and are equally liable. Assets contributed by any partner can be equally distributed if the partnership dissolves. Therefore if you decide to go into a partnership it is generally wise to draw up a partnership agreement to map out the parameters of the agreement.
